JUSTICE ARUN KUMAR ORAL ORDER 07-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Khagaria (Chitragupta Nagar) PS Case No. 514 of 2017 registered under Section 392 of the IPC.

The allegation in brief is that four miscreants looted 3,29,300/- rupees and mobile of the informant who was returning back after collection of the money.

Learned Counsel for the petitioner submits that the petitioner was not put on TIP, the police has submitted charge-sheet in this case, only made accused on the basis of confessional statement and recovery of 4200/- rupees for which another case was instituted but that money was his personal money and not related with the present case. Another co-accused similarly situated has been admitted to bail by a coordinate Bench of this Court and the petitioner is in custody since 1.9.2017.

Having considered the said facts and circumstances, the petitioner, namely, Abhimanyu Kumar Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri B. Kumar, Jusdicial Magistrate, lst Class, Khagaria in connection with Khagaria (Chitragupta Nagar) PS Case No. 514 of 2017.

The petitioner is directed to appear before the trial court on

Patna High Court Cr.Misc. No.7195 of 2018 (2) dt.07-02-2018 each date and in case of failure to appear on two consecutive dates except because of medical emergency his bail bonds shall be liable to be cancelled.
