2. In the instant petition, petitioner has prayed for following reliefs:

"(i) For issuance of a writ, in the nature of Mandamus, seeking direction to the Respondent No. 5, the Engineer-in-Chief Rural Works Division to publish Final cadre list of Junior Account clerk according to seniority.

Provisional Cadre list was already been published to remove defects, if any and then final cadre list will be published. The

Patna High Court CWJC No.6010 of 2020 dt.13-12-2021 2/3 petitioner has already removed the defects and sent it the authority concerned, on 17.05.2017. Till now final list has not been published.

(ii) For issuance of a writ, in nature of writ of Mandamus seeking direction to the Respondent No. 5 the engineer-in-Chief, Rural Works Department to give Promotion and monetary benefits to the petitioner and others according to Seniority.

(iii) For issuance of any other writ or writs, direction or directions, command or commands, order or orders as Your Lordships may deem fit and proper in the circumstances of the case."

3. Short question for consideration in the present petition is relating to finalization of seniority list relating to the cadre of Junior Accounts Clerk. Provisional seniority list was notified inviting the objections from the affected persons. Therefore, it has not attained finality after due rectifying the defects, if any, in the provisional list, petitioner stated to have sent objections to the Department on 17.05.2017.

In the light of these facts and circumstances, 5th respondent-Engineer-in-Chief, Rural Works Division, Sonpur (Saran) is hereby directed to publish final cadre list of Junior Account Clerk after due consideration of objections/suggestions/defects, if any in the provisional seniority list and complete the process of finalizing the seniority list within a period of three months from the date of receipt of

5. With the aforesaid observations, the instant petition stands disposed of.
