It is submitted by the learned counsel for the respondent-Bank that the petitioner has moved the Regional Labour Commissioner (Central) raising an industrial dispute against the penalty and assailed the order of the Appellate Authority under Section 12 of the Industrial Disputes Act. In the said proceedings, upon notice, the Bank has filed reply. Pendency of the matter is not disputed by the
Patna High Court CWJC No.4747 of 2016(3) dt.21-11-2019 2/2 petitioner though it is submitted that this Court may take up the matter in the instance proceeding.
Since the petitioner has already availed the remedy before the Authorities under the Industrial Disputes Act and the Bank has appeared, the matter will very well be looked into in the proceedings before the Regional Labour Commissioner (Central), in accordance with law.
Writ petition is disposed of.
