The petitioner seeks bail in connection with Chandi P.S. Case No.29 of 2017 registered under Section 395 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, one Rohit Kumar was apprehended by the police, who confessed his guilt and also disclosed the name of the petitioner in the commission of the alleged offence. Thereafter, the petitioner was apprehended by the police alongwith one mobile set of Micromax Company, which is not the looted
Patna High Court Cr.Misc. No.20039 of 2017 (3) dt.29-06-2017 2/2 property. The petitioner having no criminal antecedent is in custody since 02.02.2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Rashmi Prasad, Judicial Magistrate, First Class, Hilsa (Nalanda), in connection with Chandi P.S. Case No.29 of 2017. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
