The petitioner apprehends his arrest in Khagaria P.S. Case no. 70/15, registered for the offences punishable under Sections 467, 420 and other Sections of the Indian Penal Code. The District Co-operative Officer in pursuance of the order of the District Magistrate lodged this case making allegation that the petitioner played fraud by insuring the crops of the same farmers, doubling their name in order to get the subsidy amount from the Government.

It is submitted that the petitioner is a senior Branch Manager of Chola Mandalam M.S. General Insurance Company. Paddy crops and maize of one farmer was insured and had to be

No.14979 of 2015 (2) dt.12-05-2015 2/2 paid by the premium amount of Rs. 585.90/- and Rs. 1000/- respectively for which the Government subsidy was Rs. 1614.15 and Rs. 1118/- respectively. One farmer ensured his paddy as well as the maize crops but the Co-operative Officer or the District Magistrate misunderstood the facts and lodged the case. Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case No. 70/15, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi/- U T
