JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-03-2015 Heard learned counsels for the petitioner and the State. The petitioner being Incharge Headmaster of Adarsh High School, Machhargawan, is apprehending arrest in a case registered for the offences punishable under Sections 420,406,408,409,175 and 167 of the Indian Penal Code. It is alleged that petitioner misappropriated fund of bicycle and uniform scheme as well security money of the school. The accused persons also took money from the students as fees from conferring the benefits under above schemes. It is submitted by the learned counsel for the petitioner that the petitioner was given charge of Incharge Headmaster on 8.2.2014 by the order of Chairman and even during enquiry the

Patna High Court Cr.Misc. No.11513 of 2015 (2) dt.20-03-2015 2/2 petitioner was not handed over any document. From the enquiry report it appears that no document was produced, hence, the petitioner cannot be held responsible for the same as distribution of bicycle and uniform or money under those schemes were made by the regular headmaster.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, West Champaran, Bettiah in connection with Jogapatti P.S. Case No. 163 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
