The petitioner seeks bail in connection with Pirbahore P.S. Case No.290 of 2015 registered under Sections 461, 467, 468 and 420 of the Indian Penal Code.

The accusation is of withdrawing Rs.16,30,250/- through six cheques from Savings Bank Account No.1500101003775 belonging to Bihar Chemist Drugs Association in between 02.12.2015 to 08.12.2015 from the Canara Bank, G.M. Road Branch, Sharaf Bhawan, First Floor, Patna, and when the matter was verified, then account holders told that that all the cheuqes, which were represented for encashment, were

Learned counsel appearing on behalf of the petitioner submits that the petitioner is not the account holder of the account in which the amount was credited. In course of investigation, only one Babloo Singh disclosed the name of the petitioner, Arun Kumar and Aman Kumar saying that they had asked him to open the account for crediting the amount and withdrawing the same. Except that, nothing has been collected by the Investigating Officer, in course of investigation, against the petitioner. Later on, the police got recorded the confessional statement of the petitioner showing his hand in withdrawing the money. The petitioner is in custody since 18.04.2016 and, on investigation, the chargesheet has already been submitted against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Pirbahore P.S. Case No.290 of 2015. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner.
