2. The petitioner makes a prayer for grant of regular bail in connection with Banka Excise P.S.Case No. 01 of 2025 registered under sections 8, 21(C), 25 of the NDPS Act.

3. It would appear from the perusal of the first information report that cough syrup containing Codeine being total of 188 liters was seized from the room of the house of the petitioner which was searched upon the confidential information.

4. Learned counsel for the petitioner submits that there is no independent witness on the search and seizure and the total quantity, which was recovered being 188 liters referred to the cough syrup not Codeine. The content of Codeine has

Considering the fact that each bottle contains 10mg of Codeine and hence, altogether 10 gm and 80 mg Codeine has been recovered. It is further submitted that small quantity of Codeine is 10 gm and commercial quantity being 1 Kg and the said recovery would be just a little over the small quantity. The petitioner has although been earlier made an accused in another case under NDPS Act in which he is on bail but the counsel for the petitioner submits that the petitioner is about 65 years old and he got falsely implicated in the earlier case for the act of somebody else.

Considering the facts that the petitioner is in custody since 01.01.2025 and quantity recovered is just little over the small quantity, the petitioner is enlarged on bail on furnishing bail bond of Rs. 20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge (NDPS Act) Banka in connection with Banka Excise P.S.Case No.01 of 2025, subject to the condition which is as follows:- (i) One of the bailors shall be own/ close member of the family of the petitioner.

(ii)The petitioner shall co-operate in the investigation and shall appear on each and every date fixed at the trial. In case
