Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 279, 307, 354B, 504 and 302 of the Indian Penal Code.
The allegation of assault to the deceased is against co-accused Sk. Kawal and Sk. Mojmil who had allegedly assaulted with Farsa. The petitioner was member of the unlawful assembly.
Similarly Situated co-accused Shekh Jamil and Shekh Wajir have already been allowed anticipatory bail by a Coordinate Bench of this Court in Cr.Misc.No.63565 of 2017.
Patna High Court Cr.Misc. No.11415 of 2018 (2) dt.27-02-2018 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Nautan Police Station Case No.259 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
