JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-04-2022 The present petition has been filed for modifying the order dated 22.11.2021 passed in Cr. Misc. No. 4456 of 2021 to the effect that the time granted to the petitioner to surrender before the learned court below in order to avail the privilege of bail be extended by a further period of four weeks from today.

The learned counsel for the petitioner has submitted that on account of miscommunication, the aforesaid order dated 22.11.2021 could not be communicated in time, resulting in expiry of the prescribed time granted to the petitioner to enable him to surrender before the learned court below and avail the privilege of bail. Thus, it is submitted that a sympathetic view be taken and the time granted to the petitioner to surrender before the learned court below be extended by a further period of four weeks. Having regard to the facts and circumstances of the case

Patna High Court CR. MISC. No.22172 of 2022(2) dt.27-04-2022 2/2 and considering the submissions/ averments made in the present petition, I deem it fit and proper to grant further four weeks' time to the petitioner to surrender before the learned court of 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Sitamarhi in connection with Bajpatti P.S. Case No. 270 of 2020 for the purposes of availing the privilege of bail.

The order dated 22.11.2021 passed in Cr. Misc. No. 4456 of 2021 stands modified to the aforesaid extent. The rest of the order dated 22.11.2021 shall remain as such.

The petition stands disposed of.
