Heard the parties.

The petitioner is languishing in jail custody since 10.07.2019 in a case registered for the offence punishable under section 20,25, and 29 of the N.D.P.S Act.

As per allegation made in the complaint petition 45 Kilograms Ganja along with one red colour Maruti Suzuki Car were recovered in which three accused persons including this petitioner was arrested.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner was hired as a driver and he had no knowledge about the Ganja

Patna High Court CR. MISC. No.33629 of 2021(2) dt.21-12-2021 2/2 being transported in the said car. Learned counsel for the State submits that commercial quantity of Ganja has been recovered. Considering the aforesaid facts and circumstances of the case, I am not inclined to grant privilege of bail to the petitioner and, accordingly, prayer for bail of the petitioner in connection with Case no. NCB/PZU/V/15 of 2019 corresponding to N.D.P.S.Case No. 53 of 2019, pending in the court of learned Sessions Judge cum Special Judge N.D.P.S Act, East Champaran, Motihari stands rejected (Rajesh Kumar Verma, J) N.K/- U T
