JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-05-2019 This is an application for grant of anticipatory bail in connection with Kajra P.S. Case No. 31 of 2018, disclosing offences under Sections 147, 148, 149, 353, 307 of the Indian Penal code, Section 27 of the Arms Act and Section 16, 17, 18, 20 and 23 of the U.A.P. Act.

Prosecution case is that CRPF along with local police were engaged in raiding on the Naxali team and Naxals started firing causing injury to some of the police personnel. So far this petitioner is concerned, he is named in the F.I.R. as informer of the Naxali. It further appears that the petitioner is accused in one more case..

Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances as stated above, petitioner shall surrender within

Patna High Court CR. MISC. No.18531 of 2019(3) dt.06-05-2019 2/2 a period of four weeks from the receipt of this order and on surrender, he will be released on bail on furnishing bail bond of Rs. 25,000/-( Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Lakhisarai in connection with Kajra P.S. Case No. 31 of 2018, subject to that condition that laid down under Section 438(2) of the Code of Criminal Procedure.

This is further subject to the condition that the petitioner will cooperate in investigation with the police and if his involvement is found in future, the prosecution is at liberty to move for cancellation of his bail bond before the court below itself.

Let a copy of this order be communicated to the Superintendent of Police, Lakhisarai.
