The petitioner is apprehending his arrest in connection with Chanan P.S.Case no.58 of 2018 registered for offences punishable under Sections 16, 18, 20, 23 U.A.P. Act and Section 4/5 of Explosive Act.
Allegation as per FIR is that the police was in search operation and arrested Gurucharan Soren and he disclosed the name of the accused persons including the petitioner and 40 kg. of Ammonium Nitrate were recovered from his possession and further it appears that the petitioner is accused in one case as statement made in para 3, however, from the report called for from the police it appears that the petitioner is accused in three cases whereas he has mentioned only two cases. Heard learned A.P.P. also.
Patna High Court CR. MISC. No.13731 of 2019(3) dt.30-04-2019 2/2 Having heard both sides and in view of allegation as well as the conduct of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on the basis of materials available on the record.
With the aforesaid direction, this application is dismissed.
