2. The present writ petition has been filed for issuance of direction to the respondent to grant the full salary for the period of his suspension as well as for giving the petitioner the benefit of 2nd MACP for which petitioner is entitled.

3. Learned counsel for the petitioner submits that the petitioner has been exonerated from the charges but his grievances relating to payment of ACP/MACP has not been considered.In this regard he has filed his representation vide Annexure-2.

4. Counter affidavit has been filed in which the District Magistrate, Nawada, has taken the plea that the meeting of District Establishment Committee for grant of ACP/MACP could not be convened in the district of Nawada due to which claim of the petitioner could not be considered.

5. In the light of the submissions made in the pleading, this writ petition is disposed off directing the District Magistrate, Nawada, to consider the claim of the petitioner within 90 days from the date of receipt/production of a copy of this order after placing this matter before the District Establishment Committee. Since election has been notified, therefore, 90 days shall be counted from the date of end of election.
