JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 30-07-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks anticipatory bail in connection with Pakribarawan (Dhamaul) P.S. Case No. 215 of 2014 registered for the offences punishable under sections 379, 420, 120-B and 406 of the Indian Penal Code.

It has been contended that the petitioner was neither owner nor driver nor in any manner connected with the vehicle on which 400 bags of wheat were loaded. It has further been contended that the petitioner is not connected in any manner with the transport agency which had provided the truck in question. Learned counsel for the State has submitted that in course of investigation complicity of the petitioner has also

Be that as it may, regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within four weeks from today, the petitioner Md. Bablu Garrage @ Md. Perwej Alam is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawadah in connection with Pakribarawan (Dhamaul) P.S. Case No. 215 of 2014, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
