13-06-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is seeking Regular Bail in connection with Industrial Area P.S. Case No. 43 of 2017 for offences registered under Section 30 of the Bihar Prohibition and Excise Act, 2016.

The petitioner is said to be in custody since 05.03.2017.

Learned counsel for the petitioner submits that the alleged seizure has not been made from the conscious possession of this petitioner and he has nothing to do with the motorcycles which have been seized in course of raid by the patrolling party. The alleged illegal liquors were said to have been lying on the motorcycle. He also points out that

Patna High Court Cr.Misc. No.25617 of 2017 (2) dt.13-06-2017 the co-accused Ramesh Rai and Vikash Kumar Paswan have been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 24916/2017.

Learned Additional Public Prosecutor opposed the prayer for bail of the petitioner, however, considering the fact that the petitioner has no criminal antecedent and the co-accused have been granted bail as also that the petitioner is in custody for more than three months, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Vaishali at Hazipur, in connection with Industrial Area P.S. Case No. 43/2017.
