The petitioner seeks bail in connection with K.Hat P.S. Case No. 97 of 2016, registered under Sections 376 and 511 of the Indian Penal Code.

The accusation is that on 10.03.2016 at about 11.30 P.M. when informant was going to sleep then this petitioner entered in her house and tried to commit rape upon her on the point of knife, but in the meantime, her brother came after attending marriage ceremony, then petitioner fled away through window.

Learned counsel for the petitioner submits that petitioner is neighbour of the informant and due to land dispute this false case has been lodged. The petitioner has no criminal

Patna High Court Cr.Misc. No.28089 of 2017 (2) dt.22-06-2017 2/2 antecedent is in custody since 08.03.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with K.Hat P.S. Case No. 97 of 2016.
