JUSTICE BIRENDRA KUMAR ORAL ORDER 27-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 147/148/149/120B/121A of the Indian Penal Code, Sections 25(1-b)a/26 of the Arms Act and Sections 16/17/18/19/20/21/22 of the U.A. P. Act. One Saudi Yadav was apprehended by the police and from his possession country-made pistol etc. were recovered. Saudi Yadav has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.47819 of 2017.

Submission is that the name of the petitioner and others surfaced in the confessional statement of Saudi Yadav. Petitioner has got no criminal antecedent. Petitioner is in custody

Patna High Court Cr.Misc. No.25482 of 2018 (2) dt.27-04-2018 P2/ since 27.11.2017.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sono (Charkapathar) P.S. Case No.27 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
