The petitioners seek bail in anticipation of their arrest in connection with Baikunthpur P.S. Case No. 311 of 2018 dated 28.12.2018 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition & Excise Act.

69 litres of liquor is said to have been recovered from the bamboo orchard of one Munshi Mahto. During the course of search and seizure, one Punyadeo Mahto was arrested who has disclosed the name of the petitioners as well.

Regard being had to the fact that there is no

No.12149 of 2019(2) dt.28-02-2019 2/2 recovery from the possession of the petitioners and that they have clean antecedents, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge (Excise), Gopalganj in connection with Baikunthpur P.S. Case No. 311 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
