This is an application for bail in connection with Adhoura P.S.Case No. 60 of 2014, G.R.No. 1813 of 2014, registered for the offences punishable under Section 366A of the Indian Penal Code.
Allegation against the petitioner is of kidnapping the daughter of the informant.
It has been submitted on behalf of the petitioner that FIR itself shows that the occurrence of kidnapping took place one and a half years prior and no Sanha or police case has been lodged against the petitioner and further allegation as per FIR against the petitioner is that he came to the village later on and remained in the village but he has not brought his daughter and in respect of
Patna High Court Cr.Misc. No.29097 of 2017 (3) dt.18-07-2017 2/2 that no such case has been filed. It has further been submitted that petitioner is in custody for the last two months. Heard learned APP also, who has opposed the prayer for bail.
Having heard both sides and considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. However, petitioner may renew his prayer for bail after framing of charge in this case.
Accordingly, this application is dismissed.
