The petitioner seeks bail in connection with Parbatta P.S. Case no. 6 of 2018 registered Sections 30(a), 38(i) of Bihar Prohibition & Excise Act-2016.
51.480 lts. of foreign liquor is said to have been recovered from Bolero vehicle and its driver managed to escape while petitioner sitting in the said vehicle was apprehended. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern with the seized liquor. He happens to be simple commuter of the said vehicle and had no no knowledge of keeping of the said liquor
Patna High Court Cr.Misc. No.25552 of 2018(2) dt.02-05-2018 2/2 in the said vehicle. He has been falsely implicated in the case at the instance of his enemy. He has no criminal antecedent. He has been languishing in custody since 28.01.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bhagalpur in connection with Parbatta P.S. Case no. 6 of 2018.
