JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-06-2020 Heard learned counsel appearing on behalf of the petitioner, learned counsel appearing on behalf of the State as well as learned counsel for the informant.
The petitioner is in custody in connection with Chiraiya P.S. Case No. 510 of 2019 for the offence under Sections 363, 366A and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 07.11.2019.
It is alleged that the petitioner has kidnapped the daughter of the informant.
Learned counsel appearing on behalf of the petitioner would submit that the informant's daughter is more than 18 years old and in her statement recorded under Section 164 of
Patna High Court CR. MISC. No.11332 of 2020(3) dt.05-06-2020 2/2 the Cr.P.C., she has not stated about ill-treatment by the petitioner. The material have come in the case diary to suggest that the petitioner and the informant's daughter were in love affairs.
Considering the totality of the facts and circumstances of the case including the statement of the victim under Section 164 of the Cr.P.C. to the effect that no wrong was done with her by the petitioner, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. Sikarahna at Dhaka, East Champaran in connection with Chiraiya P.S. Case No. 510 of 2019, subject to the condition that on release, the petitioner shall render his service as volunteer in the District Health Centre for a period of one month in dedicated Covid hospital. He is required to report the District Nodal Officer in the concerned region who shall utilise the service of the petitioner appropriately. (Anil Kumar Upadhyay, J) BT/- U T
