The petitioners seek bail in connection with Barachatti P.S. Case No. 646 of 2017 registered under Sections 30(a), 38 and 47 of Bihar Prohibition and Excise Act. 50 lts. of country made liquor is said to have been recovered from the house of the petitioners Punam Devi and Sarita Devi each and they were apprehended by the police. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from their conscious physical possession. Their houses are inhibited by several persons. They have no criminal antecedent. Both the

Patna High Court Cr.Misc. No.1556 of 2018 (2) dt.24-01-2018 petitioners are ladies. The petitioner no. 2 is pregnant. The petitioners have been languishing in custody since 13.10.2017. In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Gaya in connection with Barachatti P.S. Case No. 646 of 2017.
