JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-05-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 467, 468, 471, 420/34 of the Indian Penal Code.

As per the prosecution case, on the alleged date and time of occurrence co-accused, Mahendra Rai, tried to withdrew money from the account of Ram Lakhan Pandit by affixing his photographs in place of Ram Lakhan Pandit. On enquiry, Mahendra Rai disclosed that he was asked by this petitioner to withdraw the money.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that petitioner has been made accused in

Patna High Court CR. MISC. No.13253 of 2022(2) dt.10-05-2022 2/2 this case on the basis of disclosure made by co-accused, Mahendra Rai. Petitioner is in custody since 12.10.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa PS case No. 280/2021.
