The petitioner seeks bail in C-III Case No. 326 of 2017 registered under Section 30(a) of the Bihar Prohibition Excise Act, 2016.
14.58 litres of country made liquor is said to have been recovered from the joint house of the petitioner and coaccused Manoj Kumar @ Teni. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern with the seized liquor and the alleged recovery has been planted against the
Patna High Court Cr.Misc. No.1929 of 2018 (2) dt.24-01-2018 2/2 petitioner at the instance of his enemies. The petitioner has been languishing in custody since 07.11.2017.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District and Sessions Judge, Siwan in connection with C-III Case No. 326 of 2017.
