JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-06-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Hilsa P.S. Case No. 17 of 2020 for the offence under Sections 366(A) of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner would submit that the allegation against the petitioner is that he enticed the daughter of the informant and kidnapped her for the purpose of marriage. The petitioner is in custody since 10.01.2020.
In this case, carbon copy of the case diary was called for by order dated 02.03.2020 and the same is available on record. From perusal of the statements of the witnesses made in paragraph 37 and 38 of the case diary it appears that the

Considering the fact that the petitioner has no criminal antecedent and the case diary indicates that the petitioner and informant's daughter were in love affair and the petitioner has remained in custody for nearly six months, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M, Hilsa, Nalanda in connection with Hilsa P.S. Case No. 17 of 2020, subject to the condition that on release, the petitioner shall render his service as volunteer in the District Health Centre for a period of one month in dedicated Covid hospital. He is required to report the District Nodal Officer in the concerned region who shall utilise the service of the petitioner appropriately.
