Petitioner, already in custody, seeks bail in connection with Hilsa P.S. Case No. 337 of 2017, registered under Sections 341, 323, 307 and 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that both sides are agnates and the allegation against the petitioner is that he opened fire, which did not hit, and there is no recovery of any arm from the possession of the petitioner. It has further been submitted on behalf of the petitioner that he is in custody since 22.10.2017 and charge-sheet has also been submitted in this case. Having considered the said facts and circumstances,
