JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 20 and 22 of the NDPS Act.

From the house of the petitioner, 50 kgs. of ganja were recovered.

It is submitted by learned counsel for the petitioner that recovery has been made from under-construction house of the petitioner and the petitioner is not residing at the place of seizure. Considering the nature of accusation, this Court is not inclined to interfere.

Accordingly, the application is rejected in connection with Special Case No. 13 of 2014 arising out of Kishanpur P.S. Case No. 176 of 2014 pending in the court of learned Sessions
