2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 7 of the Essential Commodities Act.
3. According to F.I.R., on 18.12.2023, PDS shop of the petitioner was inspected and 89.934 quintal rice and 16.326 quintal wheat was found short.
4. It is submitted on behalf of the petitioner that the inspection was made behind the back of the petitioner and at the relevant point of time, petitioner was hospitalized in DMCH. It is next submitted that there was no shortage of foodgrains rather false report has been prepared due to absence of the petitioner at
Patna High Court CR. MISC. No.18867 of 2024(3) dt.07-05-2024 2/2 the time of the inspection. It is lastly submitted that PDS license of the petitioner has already been suspended on 20.12.2023.

Considering the fact that PDS license of the petitioner has already been suspended, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of her arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Sheohar in connection with Tariyani P. S. Case No. 291 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
