The petitioner seeks bail in a case instituted for the offences under Sections 498A, 304B, 201/34 of the Indian Penal Code.
Allegation against the petitioners is of committing torture upon the victim and thereafter killed the victim due to non-fulfilment of demand of dowry.
It has been submitted on behalf of the petitioner that the petitioners are in custody since 20.07.2017 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. Charge-sheet has been submitted in the present case. The petitioners are father-in-law
Patna High Court Cr.Misc. No.4954 of 2018(3) dt.07-03-2018 2/2 and bhainsur respectively of the deceased. They have falsely been implicated in the present case due to petty family dispute. They are separate in mess and property from the husband of the deceased.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Gopalganj in connection with S. Tr. No. 621 of 2017 (arising out of Bishambharpur P.S. Case No. 75/2017).
