JUSTICE VIKASH JAIN ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner is in custody since 19.01.2017 in connection with Bihra P.S. Case No. 07 of 2017 for the offences alleged under Sections 366A, 376, 511 and 323 of the Indian Penal Code.

3. It is submitted that the petitioner has been falsely implicated and the informant happens to be major as evident from her school leaving certificate (Annexure-2). The informant happens to be distantly related as she is the sister-in-law of maternal brother of the petitioner and the allegations are improbable in nature. The petitioner claims clean antecedents.

4. Having regard to the nature of accusations and gravity of offence alleged and considering, however, that the informant has reiterated the allegation in her deposition recorded under Section 164 of the Code of Criminal Procedure with specific accusation against the petitioner and also charge sheet has been submitted against him in respect of the alleged offence, this Court is not inclined to grant the privilege of bail to the petitioner. The bail petition stands dismissed.
