JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2015 Heard learned counsels for the petitioners and the State. The petitioners being the parents, brother and brother's wife of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Sections 498A, 406, 323 and 307/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The accusation is of torture for non-fulfilment of the dowry demand and making assault to the informant at pregnancy stage.
It is submitted by learned counsel for the petitioners that the accusation is not specific against the petitioners. A statement has been made in para 13 of the petition that no injury report of
Patna High Court Cr.Misc. No.4783 of 2015 (3) dt.18-02-2015 2/2 the informant is on record.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Nawada in connection with Nawada Mahila P.S. Case No. 15 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
