JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section-414 of the Indian Penal Code.
Two persons were arrested with stolen motorcycles and the aforesaid two apprehended persons disclosed name of the petitioner and several other persons, who are said to be involved in stealing and selling of motorcycles. Subsequently, police reached at the house of petitioner and, two motorcycles were recovered from a hut, which was found by the side of house of the petitioner. Learned counsel for the petitioner submits that as a matter of fact, only one motorcycle was found in the hut, situated near the house of the petitioner and as a matter of fact, the

No.11654 of 2016 (2) dt.15-03-2016 2/2 aforesaid motorcycle belongs to petitioner but due to village politics, police roped the petitioner by placing another motorcycle in the seizure list of the present case. It is further submitted that the petitioner does not have any criminal antecedent and is languishing in jail custody since long.
Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sahebganj P.S. Case No. 21 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, West, Muzaffarpur.
