1. Heard learned counsel for the petitioners and learned AC to GA-2.
2. The learned counsel for the petitioners submits that the instant writ application has been filed for a direction upon the respondents not to construct Panchayat Sarkar Bhawan on his purchased land pertaining to Tauzi No.786, Khata No.259, Khesra No.2824, Area 51 decimal. It is submitted that the said land was purchased vide sale deed no.12918 dated 26.10.1983. It is further submitted that the land was purchased by father of the petitioner and since the date of purchase the petitioner is in
Patna High Court CWJC No.4702 of 2025(2) dt.01-07-2025 2/2 possession but then it is submitted that even without acquiring and paying compensation to the petitioners, his raiyati land has been acquired for construction of Panchayat Sarkar Bhawan.
3. The learned counsel appearing on behalf of the State submits that petitioners instead of rushing to this Court ought to have moved before the District Magistrate, Patna seeking redressal of their grievance.
4. At this stage, the learned counsel appearing on behalf of the petitioners seeks permission to withdraw the writ application with liberty to file representation before the District Magistrate, Patna for seeking redressal of their grievance, as raised in the instant writ application. It is submitted that representation before the Collector, Patna would be filed on or before 17.07.2025. In the event if any representation is filed before the Collector, Patna on or before 17.07.2025 in that event the Collector, Patna shall consider and dispose of the same within a period of two months thereafter, in accordance with law, after giving opportunity of hearing to the petitioners.
