JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-03-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

It is alleged that 11 plastic dabba each containing 40 litre of kerosene oil was recovered from an auto rickshaw, registered in the name of wife of the petitioner, driven by one Ramanuj Kumar, which was carrying for black marketing. Learned counsel for the petitioner submits that neither the recovery was made from the possession of the petitioner nor he was present there and the alleged auto rickshaw is public carrier.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

No.12775 of 2015 (2) dt.26-03-2015 2/2 Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Rafiganj P.S. Case No. 8 of 2015, pending before the Chief Judicial Magistrate, Aurangabad.

With the above observation, this application is, accordingly, disposed off.
