Mr.Abhay Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-03-2020 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Kotwa P.S. Case No. 35 of 2019 for the offence under Sections 420/34 of the Indian Penal Code.

Allegation against this petitioner is that he has introduced the informant to one Shamsher Ali in connection with purchase of vehicle.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that the prosecution case is that the informant paid Rs.4,00,000/- (Four lac) to Shamsher Ali, but Shamsher Ali has not handed over the vehicle to the informant.

Considering the fact that the petitioner has only introduced the informant to one Shamsher Ali in connection with purchase of vehicle and also the fact that Shamsher Ali has

No.11952 of 2020(2) dt.05-03-2020 2/2 been granted bail by the court below itself, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Kotwa P.S. Case No. 35 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
