NILU AGRAWAL ORAL ORDER 22-06-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in custody since 02.04.2017 in a case registered for offences punishable under Sections 30 (A), 32(2) and 41 (1) of the Bihar Prohibition and Excise Act. The prosecution case as lodged by the police personnel is that a consignment of liquor was coming from Muzaffarpur which was to be delivered on basis of payment. The petitioner was apprehended with Rs. 4 lakhs in his pocket and black Apache motorcycle.

It has been submitted by the learned counsel for the petitioner that he is innocent has no criminal history and has been

No.26356 of 2017 (4) dt.22-06-2017 2/2 falsely implicated in the aforesaid case and money which was carrying, was his own and other accused persons has been granted the privilege of bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 25036 of 2017 dated 05.06.2017. However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge- II- Cum- Special Judge, Vaishali at Hajipur in connection with Vaishali P. S. Case No. 82/ 2017.
