The petitioner is apprehending his arrest in connection with Goreakothi P.S.Case No.182 of 2018 , registered for offences punishable under Sections 302, 304(B), 120(B)/34 of the Indian Penal Code.

Allegation against the petitioner, who happens to be mother-in-law of the deceased, is of dowry death. Submission of the learned counsel for the petitioner is that actually the deceased met with burn injury and she was taken to Gorakhpur Hospital and during treatment she died . The informant was present there and no case was lodged earlier and after she died, the present case has been lodged making false allegation against the petitioner and other

Heard learned A.P.P. , who has opposed the prayer for bail but could not controvert the fact that she died at Gorakhpur Hospital and the petitioner is mother-in-law. . Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan in connection with Goreakothi P.S.Casae No.182 of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
