====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 16-11-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Muzaffarpur Town P.S. Case No. 228 of 2019 registered for the offence under Sections 387 and 120(B) of the Indian Penal Code.

The case is of extortion with the demand of rupees five lakh.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, the petitioner has not been named in the F.I.R. rather his name transpired in this case during course of investigation after one year. As a matter of

No.22357 of 2021(3) dt.16-11-2021 2/2 fact, the petitioner happens to be a social activist and he used to raise voice against the corrupt practices of government official and on account of the same, he has falsely been made accused in this case. Charge-sheet has already been submitted in this case. The petitioner is rotting in judicial custody since 07.01.2020.

Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur in connection with Muzaffarpur Town P.S. Case No. 228 of 2019.
