JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-06-2017 Heard learned counsel for the petitioner, learned counsel appearing on behalf of the informant and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Fatuha P.S. Case No. 13 of 2017, registered under Section 363, 302 and 201 of the Indian Penal Code.

The accusation is that on 17.01.2017, cousin sister of the informant left the house early in the morning without any information. In course of search, informant came to know that Gayatri Kumar, cousin sister of the informant, was seen moving towards four lane.

Learned counsel for the petitioner submits that after four days of the lodging of the F.I.R. dead body of cousin sister of the informant was recovered to the pond, thereafter, informant

Patna High Court Cr.Misc. No.28087 of 2017 (2) dt.22-06-2017 2/2 gave restatement raising suspicion against the petitioner having hand in the murder of his cousin sister saying that there was love affairs in between petitioner and his cousin sister, except suspicion nothing has been collected against the petitioner to show his involvement in the present case. Further submission is that after investigation, the Police has submitted Chargesheet in this case. Further submission is that petitioner has no criminal antecedent is in custody since 23.01.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna City in connection with Fatuha P.S.
