JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 448,341,323 and 354B of the Indian Penal Code and section 3(1)(x) & (xii) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
It is alleged that the petitioner entered into the house of the informant and tried to outrage her modesty. It is submitted by the learned counsel for the petitioner that petitioner is neighbour of the informant. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that the informant
Patna High Court Cr.Misc. No.10419 of 2016 (2) dt.04-03-2016 2/2 retracted from the initial version and has filed a petition to that effect before the learned court below.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Kaimur at Bhabua in connection with Bhabua SC/ST P.S. Case No. 2 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
