Petitioner seeks regular bail in connection with Special Case No.1656/2017 (arising out of Ramkrishna Nagar P.S. Case No.257/2016) registered for the alleged offences under Section 30 (a) and 47 of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, 585 liters of illegal foreign liquor was seized from the Tata Magic vehicle and the petitioner, who happens to be the driver of the said vehicle, was apprehended.
It has been submitted by learned counsel for the petitioner that the petitioner is an innocent and has committed no offence. He has been falsely implicated in this case. It has been

No.29417 of 2017 (02) dt.01-07-2017 2/2 further submitted that the petitioner happens to be the driver of the said vehicle and he was driving the vehicle at the instance of his owner and had no knowledge of hiding the liquor under the bag of the husk. The allegations levelled against the petitioner are general and omnibus in nature. He has been languishing in jail custody since 24.12.2016.
In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Special Judge Excise Act, Patna in connection with Special Case No.1656/17 (arising out of Ramkrishna Nagar P.S. Case No.257/16).
