JUSTICE PARTHA SARTHY ORAL ORDER 08-07-2020 Heard learned counsel for the petitioners and learned APP for the State, through video conferencing. The petitioners have filed the instant application for grant of anticipatory bail in connection with Ara Muffasil P.S. Case No. 287 of 2017 registered under sections 498A, 494 and 379 of the Indian Penal Code.

As per allegation in the FIR, it is stated by the informant that she was tortured by the accused persons for nonfulfillment of demand of dowry. It is submitted by learned counsel for the petitioners that petitioners are father-in-law, elder brother-in-law and sister-

It is further submitted that co-accused Amarjeet Paswan, the husband of the informant has been enlarged on bail in the instant case vide order dated 8.4.2019 passed in Cr. Misc. No. 19025 of 2019.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including grant of bail to the co-accused, husband of the informant, the Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of eight weeks from today and in the event of their arrest or surrender in connection with Ara Muffasil P.S. Case no. 287 of 2017, they will be enlarged on bail on each of them furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara subject to the condition as laid down under section 438(2) of the Cr.P.C.
