Petitioner apprehends arrest in connection with Banshi P.S. Case No. 70 of 2017 registered for the offence under sections 304B/201/34 of the Indian Penal Code. Petitioner has earlier moved this Court for grant of bail in Cr. Misc. No. 59118 of 2018 which was dismissed on 28.08.2020.
Learned counsel for the petitioner submits that the fresh grounds for renewing the prayer for bail is that the dispute between the parties have been compromised and a compromise petition (Annexure-3) to that effect has been filed in the Court below. It is further submitted that the husband of the deceased
Patna High Court CR. MISC. No.23237 of 2021(10) dt.26-07-2023 2/2 has been acquitted by the Court below in the trial. Petitioner has no criminal antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named, is directed to be released on bail on furnishing personal bond to the satisfaction of Additional Chief Judicial Magistate I, Arwal in connection with Banshi P.S. Case No. 70 of 2017 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Arvind Srivastava, J) mcv/- U T
