JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-05-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, on the alleged date and time of occurrence while the informant and the victim were returning on motor cycle, three FIR named accused persons, including this petitioner, and three unknown persons stopped the motor cycle and thereafter it is alleged that this petitioner along with two other accused persons caught hold of the victim and co-accused Jwala Singh fired at him as a result of which he sustained injuries and died during the course of treatment. Learned counsel appearing for the petitioner submits

Patna High Court CR. MISC. No.13232 of 2022(2) dt.10-05-2022 2/2 that specific allegation of firing is against co-accused, Jwala Singh. So far this petitioner is concerned, he is only alleged to have facilitated the crime by catching hold of the victim. Petitioner claims clean antecedent and is in custody since 26.10.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Kaimur at Bhabua in connection with Bhagwanpur PS case No. 190/2021.
