Petitioner seeks bail in Naubatpur P.S. Case No.318 of 2017 instituted for the offence under Section(s) 376, 511, 302/34 Indian Penal Code pending in the Court of the Additional Chief Judicial Magistrate, Danapur, Patna. In the written report, it is alleged that while wife of the informant had gone for attending call of nature this petitioner wanted to commit rape with her, but he could not succeed, then he assaulted wife of the informant. It is further alleged that when this petitioner along with his friend, Dharmendra Kumar, did not succeed in committing rape, they pushed down wife of the informant on ground and inserted iron rod in her private parts after removing her Saree causing serious

Patna High Court CR. MISC. No.14279 of 2019(4) dt.25-07-2019 2/2 bleeding injury to her. She, ultimately, died on account of such injury.

Case diary and postmortem report has been received. Doctor has found injury on the person of deceased, which corroborates the allegation against the petitioner. In such circumstances, this Court is not inclined to enlarge the petitioner on bail.

Prayer of the petitioner for grant of bail is rejected. The trial Court is directed to expedite the trial. (Sanjay Priya, J) J. Alam/- U T
