JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 20.4.2017 passed in Cr.Misc.No. 11453 of 2017 with direction to learned trial court to conclude the trial within a period of nine months.

Submission of learned counsel for the petitioner is that period of nine months has already expired and out of five witnesses four have been examined and they have been declared hostile.

Heard learned APP also.

Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the petitioner at this stage.

However, learned trial court is directed to expedite the

Patna High Court Cr.Misc. No.8267 of 2018 (2) dt.28-02-2018 2/2 trial and try to conclude the same within a further period of two months and if trial is not concluded within the said period, petitioner is given liberty to renew his prayer for bail before the court below, which shall be considered on the basis of materials available on record at that time and learned court below will pass appropriate order, without being prejudiced by this Court. With the above observation, this application is disposed of.
