The petitioner seeks bail in anticipation of his arrest in connection with Thakraha P.S. Case No. 148 of 2018 dated 03.12.2018 instituted for the offences under Section 30(a) of the Bihar Prohibition & Excise Act. 4.8 litres of liquor is said to have been recovered from a stack of hay kept outside the house of the petitioner. Since the recovery is from an open space without any enclosure and not from the possession/constructive possession of the petitioner and the petitioner having clean antecedents, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of
