JUSTICE PURNENDU SINGH ORAL ORDER 10-08-2023 Heard Mr. Dinesh Maharaj, leaned counsel appearing on behalf of the petitioner; Mr. Raj Nandan Prasad, learned counsel for the Accountant General (Bihar) and Mr. Kamlesh Kishore, learned AC to SC 12 for the State.

2. Learned counsel for the respondents files Supplementary Counter Affidavit on behalf of Respondent no.3 in the Court today itself. Let it be kept on record.

3. Learned counsel appearing on behalf of the petitioner informs that the substantial amount of retiral benefit has been paid to the petitioner, however, in spite of sanction

Patna High Court CWJC No.3420 of 2023(3) dt.10-08-2023 2/3 letter having been issued to the Accountant General (Bihar), authority slip has not been issued, as per instruction, up-till-date.

4. Mr. Raj Nandan Prasad, learned counsel appearing on behalf of the Accountant General (Bihar) is present in the Court and he submits that he will inform the Accountant General (Bihar) to take immediate steps to fix the family pension of the petitioner and send the authority slip to the Treasury Officer, Supaul.

5. The Treasury Officer, Supaul is directed to forthwith credit the entire amount of pensionary benefit in the account of the petitioner not beyond a period of one week from the date of receipt of the authority slip.

6. In case the petitioner is still aggrieved on account of non-payment of any other dues and interest, if so advised, she may file a detail representation before the Civil Surgeon, Supaul for any other reliefs which have not been redressed.

7. On perusal of order dated 19.07.2023, it appears that in paragraph no.3 of the order, the petitioner has been mentioned as 'minor' whereas it has been informed by the learned counsel that at the time of death of her mother (deceased employee), the petitioner was major. As such, the same is rectified to be treated as 'major' and other parts of order dated

Patna High Court CWJC No.3420 of 2023(3) dt.10-08-2023 3/3 19.07.2023 shall remain intact.

8. With the above observation/direction, the present writ petition is disposed of.
