JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2019 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 18.10.2017 passed in Cr.Misc.No. 46174 of 2017 and the allegation against the petitioner is of killing the husband of the informant.

Submission of learned counsel for the petitioner is that there is no substantial progress in trial and he is in custody for about 2 and a half years.

Heard learned APP and perused the report, from which it appears that now charge has been framed on 4.1.2018 and summons has been issued for producing the witnesses but none of the witnesses produced by the prosecution till date. Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner. However, considering the period of custody, learned

No.12265 of 2019(3) dt.11-04-2019 2/2 trial court is directed to expedite the trial and at the same time Superintendent of Police, Jamui is directed to ensure the presence of the witnesses in court on the date fixed so that the trial may be expedited and concluded at the earliest. With the above observation, this application is dismissed.
